Definitions

§1

In these Terms & Conditions, hereinafter referred to as the “Terms and Conditions”, the following terms should be understood to mean:

  1. “Account” means an account created on the Website in accordance with the rules set out in the Terms and Conditions.

  2. “Service Provider” refers to Smart Prospects Ltd., private limited company, registered at Registrar of Companies for England and Wales under the number 084223213 whose registered head office is at Orchard House, 15 Market Street, TF2 6EL, Telford, United Kingdom.

  3. “Services” means services provided by the Service Provider electronically via the Website, specified in detail in the Terms and Conditions.

  4. “University” refers to a university in the United Kingdom.

  5. "Guest" refers to a user who is not logged in.

  6. “User” refers to an "Registered User" or "Guest".

  7. “Registered User” refers to a User who has an Account.

  8. “Applicant” refers to a Registered User who uses the Apply with UniEdu service (defined in paragraph 9 below) and has an account in the UCAS system with the Service Provider's buzzword or who applies for studies at a University outside the UCAS system with the support of the Service Provider as an agent or representative.

  9. “Website” means the website https://www.uniedu.uk ; https://app.uniedu.uk ; https://www.sp.edu.pl and its subpages.

General provisions

§2

  1. The Terms and Conditions define the rules for the provision of electronic services by the Service Provider to Users, in particular the rights and obligations of the Service Provider and Users.

  2. Before commencing to use the Services, the User is obliged to read the content of the Terms and Conditions.

  3. The Terms and Conditions constitute an integral part of the provision of electronic services by the Service Provider to the User, and the Users should familiarise themselves with these Terms and Conditions and abide by them.

§3

The User may be an adult or a minor, provided that they obtain the consent of a legal representative, a legal person or an organisational unit without legal personality, to which the law grants legal capacity.

§4

4.1 The use of the Website is free of charge. 

4.2 The use of the Services is free of charge as long as the user is an Applicant. 

4.2.1 Post-application support: the Service Provider reserves the right to charge for using certain services when a person does not have an account in the UCAS system with the Service Provider's buzzword (and with the Service Provider registered as an agent/representative) or when a person applies for a master’s degree directly via university’s portal not via MasterApply and without the Service Provider registered as an agent/representative (‘Non-Applicant’). At a choice of the Service Provider and to the best of its abilities, additional services can be provided to a Non-Applicant but the Service Provider reserves the right to decline providing such services to a Non-Applicant. The contract for the provision of such services to the Non-Applicant is concluded between the Non-Applicant and the Service Provider when the purchase of those services is finalised. 

 

Please note that such charges as specified in clause 4.2.1 are not applicable to Applicants.

§5

The Service provider prohibits the following:

  1. Posting on the Website, in application documents, messages and related social media, run by or cooperating with the Service Provider, in particular Facebook groups to which the Service Provider allows access, of any illegal content, contrary to the principles of social coexistence, violating good custom or contrary to the Terms and Conditions, as well as any harmful files;

  2. Posting on the Website, in application documents, messages and related social media, run by or cooperating with the Service Provider, in particular groups on Facebook, to which the Service Provider allows access, of information or data, including personal data, false or untrue, in in particular, impersonating other people;

  3. Sending unwanted messages (spam), in all its forms;

  4. Making or attempting to interfere with the Website or any other IT systems or resources of the Service Provider;

  5. Violating the personal rights of the Service Provider or any third parties;

  6. Acting to the detriment of the Service Provider or any third parties;

  7. Any modification of the content made available on the Website using tools not provided by the Website; and

  8. Copying, modifying or otherwise affecting any part of the Website.

Services provided by the Service Provider

§6

  1. The Website is a multilateral platform that gives the opportunity to obtain information about studies at Universities and to apply for courses at Universities with the support of the Service Provider.

  2. As part of the Website, the Service Provider offers the following Services (which are defined in these Terms and Conditions in paragraphs 7-12 respectively):

  2. Register with UniEdu,

  3. Apply with UniEdu,

  4. UniEdu Can-I-Apply,

  5. UniEdu QuickApply,

  6. UniEdu MasterApply

Use UniEdu

§7

  1. The Use UniEdu service is available to Users.

Register with UniEdu

§8

  1. The Register with UniEdu service is available to Users who do not have an Account.

  2. The service Register with UniEdu enables the User to take advantage of the UniEdu Services requiring a User Account. 

  3. In order to create an Account, the Guest completes and sends to the Service Provider an appropriate form on the website at: https://www.app.uniedu.uk/register. This form should contain at least: name, surname, email address, nationality, planned start date of studies, immigration status, country of residence. To create an Account and use the Register with UniEdu service, the User must confirm that they have read the Terms and Conditions, accept the content and agree to abide by it. This declaration is submitted by marking the appropriate box in the completed form. As the Service Provider's form is sent, an Account is created. 

  4. Immediately after creating the Account, the User is able to log into the Account using the email and password used by the User in the Registration Form.

  5. The Service Provider agrees to enable the Registered User to complete and modify the data provided in the Account. It is the Registered User’s responsibility to ensure their contact details are correct and up-to-date.

Apply with UniEdu

§9

  1. The Apply with UniEdu service is available to Registered Users who have an account in the UCAS system with the Service Provider's buzzword or who apply for courses at a University outside the UCAS system with the support of the Service Provider as an agent or representative or by using either UniEdu QuickApply or UniEdu MasterApply Services to send the university application.

  2. The Apply with UniEdu service provides access and makes it possible to use the Services supporting the application process. Once the Apply with UniEdu process is finalised as described in this paragraph, the user becomes an Applicant.

  3. In order to use the Apply with UniEdu service, the Registered User must provide complete data in their Account with the information referred to in section 5 of this paragraph.

  4. After filling the Account information, the Applicant is directed by the Service Provider to further stages of the recruitment process, and receives support from the Service Provider in applying for courses at Universities. In particular, the Applicant shall receive from the Service Provider guidance on filling in application forms, gathering necessary documents and finalising the University application(s).

  5. In order to go through the recruitment process, the Applicant should provide necessary information about their educational history and plans regarding their further education. 

  6. By using UniEdu Services, the Applicant agrees to transfer the data provided by the Applicant to Universities or partner organisations cooperating with the Service Provider in order to include the Applicant in the recruitment process for studies at Universities with the support of the Service Provider as an agent or representative. Universities or partner organisations cooperating with the Service Provider, on the basis of the data provided to them, have the right to contact the Applicant in order to include them in the recruitment process.

  7. By using UniEdu Services, the Applicant undertakes to inform the Service Provider, at the Service Provider's request, about the stages of the recruitment process for courses at Universities, in particular with regard to information on acceptance or non-acceptance of the Applicant to study at Universities, commencement or non-commencement of studies, continuation or resignation from studies, and the possible field of study and specialisation.

  8. Further information on how personal data of the Registered User is processed can be found in §20 ‘Personal data protection’.

UniEdu Can-I-Apply

§10

  1. The UniEdu Can-I-Apply service is available to Users.

  2. The UniEdu Can-I-Apply service provides information on whether the Registered User might be eligible for government-backed student loans and grants as well as which universities the User might be able to apply to.

  3. In order to use the UniEdu Can-I-Apply service, it is necessary to provide information on: desired level of study, immigration status, residence, nationality, and most recent qualifications and educational history.

  4. The Service Provider is in no way affiliated with the Student Finance England, Student Finance Wales, Student Finance Northern Ireland, Student Award Agency Scotland, Student Loans Company, Department for Education or HM Government. It is the Student Loans Company, not the Service Provider, that ultimately decides who is eligible for loans and grants, and administers them to the Applicant at the University.

  5. It is the British Universities, not the Service Provider, that make the actual decision on whether the User’s application is going to be accepted or rejected.

UniEdu QuickApply

§11

  1. The UniEdu QuickApply service is available to Users.

  2. The UniEdu QuickApply service enables the Users to apply to certain British Universities.

  3. After sending the UniEdu QuickApply form, the Applicant is directed by the Service Provider to further stages of the recruitment process and receives support from the Service Provider. In particular, the Applicant may receive from the Service Provider, to the email address provided by the Applicant, information on the following steps as well as support in obtaining student visa, government loans and grants subject to eligibility. The Applicant may also receive SMS notifications during this stage of the recruitment process. 

  4. In order to use the UniEdu QuickApply service, the Applicant has to provide the following information: name, surname, date of birth, email address, nationality, chosen course, address, phone number, date of end of high school education, disabilities, immigration status, and copy of qualifications. Please note that in some cases, further information might be required from the Applicant for the provision of the Services.  

  5. It is the British Universities, not the Service Provider, that make the actual decision on whether the User’s application is going to be accepted or rejected.

  6. By sending the UniEdu QuickApply form, through which the Applicant expresses the wish to use the Apply with UniEdu service, the Applicant agrees to transfer the data provided by the Applicant to Universities or partner organisations cooperating with the Service Provider in order to include the Applicant in the recruitment process for studies at Universities with the support of the Service Provider as an agent or representative. Universities or partner organisations cooperating with the Service Provider, on the basis of the data provided to them, have the right to contact the Applicant in order to include them in the recruitment process.

  7. If User used the UniEdu QuickApply as a Guest, an Account will be registered for Register with UniEdu service.

  8. By sending the UniEdu QuickApply form, through which the Applicant expresses their wish to use the Apply with UniEdu service, the Applicant undertakes to inform the Service Provider, at the Service Provider's request, about the stages of the recruitment process for courses at Universities, in particular with regard to information on acceptance or non-acceptance of the Applicant to study at Universities, commencement or non-commencement of studies, continuation or resignation from studies, and the possible field of study and specialisation.

UniEdu MasterApply

§12

  1. The UniEdu MasterApply service is available to Registered Users.

  2. The UniEdu MasterApply service enables the Users to apply for Masters courses at British Universities.

  3. Depending on the chosen Universities, the Service Provider might charge an Applicant with a fee when sending the MasterApply Application. The fee is charged solely to cover the charges applied by the selected Universities in their application process.

  4. After sending the UniEdu MasterApply form, the Service Provider processes the Application of the Applicant and sends it to the Partner Organisations and Universities chosen by the applicant to fulfil the application process.

  5. After sending the UniEdu MasterApply form the Applicant is directed by the Service Provider to further stages of the recruitment process and receives support from the Service Provider. In particular, the Applicant may receive from the Service Provider, to the email address provided by the Applicant, information on the following steps as well as support in obtaining student visa, government loans and grants subject to eligibility. The Applicant may also receive SMS notifications during this stage of the recruitment process. 

  6. In order to use the UniEdu MasterApply service, the Applicant has to provide the following information: name, surname, date of birth, email address, nationality, chosen course, universities, address, phone number, educational history, transcripts, disabilities, immigration status, cv, references, personal statement and copy of qualifications. Please note that in some cases, further information might be required from the Applicant for the provision of the Services.  

  7. It is the British Universities, not the Service Provider, that make the actual decision on whether the User’s application is going to be accepted or rejected.

  8. By sending the UniEdu MasterApply form, through which the Applicant expresses the wish to use the Apply with UniEdu service, the Applicant agrees to transfer the data provided by the Applicant to Universities or partner organisations cooperating with the Service Provider in order to include the Applicant in the recruitment process for studies at Universities with the support of the Service Provider as an agent or representative. Universities or partner organisations cooperating with the Service Provider, on the basis of the data provided to them, have the right to contact the Applicant in order to include them in the recruitment process.

  9. By sending the UniEdu MasterApply form, through which the Applicant expresses their wish to use the Apply with UniEdu service, the Applicant undertakes to inform the Service Provider, at the Service Provider's request, about the stages of the recruitment process for courses at Universities, in particular with regard to information on acceptance or non-acceptance of the Applicant to study at Universities, commencement or non-commencement of studies, continuation or resignation from studies, and the possible field of study and specialisation.

Additional services

§13

  1. The costs and types of services provided as part of the Additional Services and packages are available at this page: https://app.uniedu.uk/order/select-service.

  2. The costs and eligibility for particular services are dependent on the service description.

Termination of provided Services 

§14

  1. The Parties have the right to terminate the provision of Services.

  2. In the event of termination of the provision of Services by the Service Provider, the Services will no longer be provided upon the expiry of the two-week notice period, counted from the date on which the notice of termination was received by the User in such a way that they could read its content. The termination may be made in writing or by email to the User's email address.

  3. The Applicant who no longer wishes to receive Services from the Service Provider can remove their Account from the Website. Upon deletion of the Account, the Services will be terminated without notice. The account may be deleted by a Registered User at any time.

  4. In order to remove their Account from the Website, the Registered User should send an email to the Service Provider at admin@uniedu.uk, in which the Registered User states that the Registered User wishes to no longer receive the Services from the Service Provider. The account is deleted by the Service Provider within 5 working days.

  5. After deleting the Account, the Service Provider confirms the Account deletion by sending relevant information via email.

  6. Termination of the Services does not violate the provisions set out in § 5, § 9 sec. 7 or § 19, nor does it require the removal of posts and other text messages posted by the User on social media related to, run by or cooperating with the Service Provider, in particular groups on Facebook, to which the Service Provider provides access.

  7. The Service Provider has the right to terminate provision of the Services  with immediate effect: 

    1.  in the event of a gross violation by the User of the provisions of the Terms and Conditions, in particular § 5. 6, § 9 sec. 7 or § 19;

    2. if the Registered User or Applicant use the services of other entities who are in competition with the Service Provider, when applying for higher education in the United Kingdom;

    3. if User using the Apply with UniEdu service lose the status of the Applicant, in particular in the event of not having an account in the UCAS system with the Service Provider's buzzword or applying to study in the UK outside the UCAS system without the Service Provider's support as an agent or representative;

    4. In case of UCAS applications, if the the option to allow the Service Provider to monitor progress of the application submitted by the Applicant on the UCAS platform is not selected (consent is given at the time of sending the UCAS application and may be changed on the UCAS Track website after the application has been sent). This information is necessary for the Service Provider to continue to reliably provide its Services after the application has been sent (including notification about the decision deadlines, support in the application for a loan, etc.). If this information is not made available, the Service Provider will not be able to provide all services offered, which may lead to the termination of the services provided (from time to time, the Service Provider agrees to ask the Applicant to change this option in the UCAS system, the provision of Services are terminated at the time of refusal or when the request is ignored by the Applicant - the termination may be withdrawn after contact and clarification of the situation with the Service Provider). 

  8. Termination of the provision of Services with immediate effect may be made in writing or by email to the User's email address. The termination of the provision of Services with immediate effect takes place the moment a breach of the Terms of Service by the User has been established.

The right to withdraw from the Services

§15

  1. The User has the right to withdraw from receiving the Services at any time.

  2. The right to withdraw from receiving the Services is exercised by submitting a declaration of withdrawal from receiving the Services to the Service Provider. The declaration may be submitted by email to admin@uniedu.uk.

Newsletter

§16

  1. A Registered User may consent to a newsletter service. The newsletter service consists of the Service Provider's information bulletin or messages containing marketing content (commercial information) about the offer of the Service Provider or its business partners and is sent periodically to the email address or telephone number provided. The subscription to the newsletter is made by selecting the appropriate option in the registration form or at a later date in the Account tab.

  2. Subscription to the newsletter is voluntary and free of charge. The newsletter service is provided for a period of time and can be unsubscribed at any time.

  3. A Registered User may unsubscribe from the newsletter at any time by sending an email to the Service Provider at admin@uniedu.uk.

The functionality of solutions based on advanced technologies 

§17

All information included in the chat by the User is provided under the sole responsibility of the User and may be processed. Details on how we process data can be found in the Privacy Policy.

Complaints procedure

§18

  1. Complaints about the services provided by the Service Provider on the basis of the Terms and Conditions may be submitted in writing or via email to the address: help@uniedu.uk.

  2. The complaint should include information about the User submitting the complaint, a description of the situation which is the basis for the complaint and an email address.

  3. Complaints are processed immediately but not later than within 14 days from the date of their receipt by the Service Provider.

  4. A response to the complaint is sent to the User’s email address provided in the complaint.

Intellectual Property Rights

§19

  1. The User acknowledges and agrees that all rights to works, trademarks and other materials made available on the Website are held by the Service Provider or third parties.

  2. The Users do not acquire any rights, in particular licences to works, trademarks and other materials made available on the Website.

  3. It is forbidden to copy the content for the purpose of competition and to release the Service Provider's materials intended only for Applicants to third parties who are not Applicants, under pain of immediate termination of the contract for the provision of services/termination of Services provided or in the event of the Service Provider incurring financial losses as a result of such breach - legal proceedings.

Personal data protection

§20

  1. Processing and transferring of personal data is controlled by the General Data Protection Regulation (GDPR) and the Data Protection Act 2018 (DPA) implementing the GDPR and any other applicable and successor laws and regulations.

  2. The administrator of the personal data is Smart Prospects Ltd., private limited company, registered in the Registrar of Companies for England and Wales under the registration number 084223213, whose registered head office is in Orchard House, 15 Market Street, TF2 6EL, Telford, United Kingdom.

  3. Personal data are processed only as permitted by law and to the extent necessary to achieve the purposes for which they were collected, in particular to the extent necessary for the provision of services and/or performance of the contract by the Service Provider, as well as for marketing purposes. A detailed description of the basis for the processing of personal data can be found in the Privacy Policy.

  4. Providing personal data is not a statutory obligation, and their provision is voluntary. However, refusal to provide them with regard to the data the provision of which the Service Provider specifies as mandatory will prevent the provision of the service and/or the performance of the contract.

  5. The User has the right to request access to their personal data, their rectification, deletion or limitation of processing, or the right to object to their processing (subject to Service Provider being legally required to process personal data or if processing personal data of the User is necessary to provide the Servicesto the User), as well as the right to transfer the data and the right to lodge a complaint to a supervisory authority. 

Technical requirements

§21

  1. In order to use the Website properly, the User needs:

    1. a computer, laptop, smartphone or any other multimedia device;

    2. Internet access;

    3. standard software such as an operating system and a web browser, the web browser should support cookies; and,

    4. in order to create an Account and in the case of Registered Users and Applicants - their own active email address.

  1. If the above requirements are not met, the use of the Website may be difficult or impossible.

Contact

§22

  1. In all matters related to the provision of the Services or performance of the contract, the User may contact the Service Provider via email at help@uniedu.uk.

  2. In all matters related to the provision of the Services or the performance of the contract, the Service Provider will contact the User via email at the address provided by the User or by telephone, if the User provides a telephone number.

Amendments to the Terms and Conditions

§23

  1. The Service Provider reserves the right to amend the Terms and Conditions if new services are introduced or existing Services are terminated, as well as in the event of any changes in applicable law that affect the content of the legal relationship between the Service Provider and the User.

  2. The Service Provider notifies Registered Users about material amendments to the Terms and Conditions and the date on which the amended Terms and Conditions will come into force by sending an email to the email address included in the Registered User’s Account. For non-material amendments to the Terms and Conditions, the Service Provider does not need to individually notify Registered Users via email.

  3. Should the User not accept the changes to the Terms and Conditions, they should send the Service Provider a message via email, stating the User does not accept the changes to the Terms and Conditions and refrain from further use of the Website. By sending the email message to the Service Provider about not accepting the changes in the Terms and Conditions, the provision of Services are thus terminated as referred to in § 12. Immediately after receiving and acknowledging the message about not accepting the changes to the Terms and Conditions, the Service Provider deletes the Registered User’s Account. After deleting the Account, the Service Provider will immediately confirm the Account deletion by sending relevant information via email.

Final Provisions

§24

The Service Provider reserves the right to temporarily suspend the provision of Services due to the necessity to carry out maintenance, repair, modernisation etc. related to the Website.

§25

The Service Provider reserves the right to temporarily suspend the provision of Services, including providing support in applying for courses at the University and providing information about the application process, in the event of a material breach of the provisions of the Terms and Conditions by the User or failure to meet the conditions for using the Services, in particular in a situation where the User loses the status of an Applicant, and until the violation ceases or the conditions for using the Services are met.

§26

The Service Provider reserves the right to introduce additional services for Registered Users or Applicants.

§27

All headings used in the content of the Terms and Conditions are for information purposes only and serve to facilitate orientation in the text.

§28

The Service Provider has the right to remove from the Website or temporarily suspend access to the content introduced to the Website by the User, if such content violates the provisions of generally applicable law, the Terms and Conditions, the principles of social coexistence or good manners.

§29

The Service Provider is in no way affiliated with the Student Finance England, Student Finance Wales, Student Finance Northern Ireland, Student Award Agency Scotland, Student Loans Company, Department for Education or HM Government. It is the Student Loans Company, not the Service Provider, that decides who is eligible to get the loans and grants, and administers them to the Applicant at the University.

§30

The Service Provider or its subsidiaries are not liable to the User in any circumstances for any losses or damages caused by disruption or failure of internet networks or for any interruptions to or restrictions on the accessibility of the Website arising for any reason or for any loss or damage arising out of or in connection with the use of the Website including, but not limited to, loss of data by the User or any other person. 

§31

The Terms and Conditions shall be interpreted in accordance with English law and the Service Provider and the Registered User submit to the exclusive jurisdiction of the English courts.

§32

The Website is not intended for persons under the age of 16.
